Pretty Art Place – Terms of Use 

These Terms of Use govern your access to and use of the images provided on the Pretty Art Place website (hereinafter, “the Site”). By accessing or using the Site, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Site. 

1.Intellectual Property and Copyright

All images displayed on the Pretty Art Place website are copyrighted works and remain the exclusive property of the respective artists. The artists retain full ownership and all associated rights, including but not limited to the rights to reproduce, distribute, publicly display, and create derivative works from the images. 

2.Permitted Use

2.1. Personal Use License 

Visitors to Pretty Art Place are granted a limited, non-exclusive license to use the images for personal, non-commercial purposes only. This includes:  

  • Creating prints or canvases for personal enjoyment. 
  • Using the images as gifts for friends or family.  

2.2. Limited Commercial Use License  

A limited commercial use license is granted for incorporating images onto physical items for resale, such as: 

  • T-shirts. 
  • Phone cases. 
  • Mugs.
  • Other similar physical products. 


3. Prohibited Use

You are expressly prohibited from engaging in the following activities: 

  • Selling the art itself as prints, canvas art, or as art for digital display (e.g., digital TV screens). 
  • Reproducing, duplicating, copying, or otherwise exploiting the material on this website for any commercial purpose beyond the limited scope explicitly permitted in Section 2.2. 
  • Sub-licensing, renting, or otherwise transferring rights to the images to any third party.

     

  • Creating any derivative works or modifications of the images without the artist’s express written consent. 


4. Consequences of Infringement

Any unauthorized use or sale of the artwork, particularly as prints or canvases, constitutes a violation of copyright and may be subject to legal action, including civil and criminal penalties. This may result in injunctions, monetary damages, legal fees, and reputational harm.  

5. Governing Law

These Terms of Use will be governed by and construed in accordance with the laws of the United States and the State of Michigan without regard to its conflict of law principles.
